While Proton is fully committed to complying with the DSA for users within the European Union, it is essential to recognize that our infrastructure and data are physically and legally located exclusively in Switzerland. As a Swiss entity, Proton remains subject to Swiss national laws, particularly regarding data sovereignty. This page outlines our contact points for EU authorities and users, and explicitly details the mandatory legal procedures required to request data, bridging the gap between EU regulatory framework and strict Swiss legal protections.

Contact Point for Member State Authorities, the Commission and the Board (Article 11)

To contact us within the meaning of Article 11 of the Digital Service Act, you can send a message to our point of contact : legal-europe@proton.ch. You will promptly receive a personal confirmation of receipt and subsequent contact will be made from our relevant department.

Alternatively, you can also contact us by post at : Proton AG, Route de la Galaise 32, 1228 Plan-les-Ouates, Switzerland. We will then contact you immediately and as requested by you (email, telephone or post).

You can contact our legal representative within the European Union, according to Article 13 of the Digital Service Act, via : Proton Europe sàrl, 94, rue de Grünewald, L-1912 Luxembourg.

Contact Point for Recipients of the Service (Article 12)

To contact us within the meaning of Article 12 of the Digital Service Act, you can send a message to our point of contact : legal-europe@proton.ch. You will receive a personal (non-automated) confirmation of receipt and a response to your enquiry at the same time or subsequently.

Please note that this point of contact is exclusively for enquiries relating to the Digital Services Act. No other requests will be answered.

Important Legal Notice: Data Requests and Swiss Law

While Proton fully complies with the DSA for EU users, Proton AG, the entity that exclusively holds and controls all user data, is domiciled solely in Switzerland. Proton Europe acts strictly as the designated representative under the DSA. It possesses no access to no access to data and has no legal authority to produce or transmit information directly. Its role is limited to administrative coordination.

In accordance with Article 10(6) of the Digital Services Act and Swiss law, any request for data disclosure will require formal international judicial cooperation as the direct transmission to foreign authorities is strictly prohibited by Article 271 of the Swiss Criminal Code.

In case of discrepancy between the English version of these Terms and any translated version, the English version shall prevail.
